Introduction
These terms set out the rules for using fun-run.co.uk. By creating an account or using our website, you agree to them.
These Terms and Conditions apply to your use of fun-run.co.uk, including our website at www.fun-run.co.uk and any related services. They should be read alongside our Privacy Policy and Website Terms of Use.
If you don't agree with these terms, please don't use fun-run.co.uk.
Who we are
fun-run.co.uk is operated by Tylney Ltd ("we", "us", "our") and runs on the Fundraisy platform. We are registered in England and Wales (company number 15279589). Our contact email is fun-run@fundraisy.co.uk.
Definitions
In these terms:
- Platform means the fun-run.co.uk website and any related services we provide.
- User means anyone who visits the website or uses fun-run.co.uk (with or without an account).
- Organiser means a person or group that creates an event, page, or collects payments through fun-run.co.uk.
- Participant means a person who signs up to take part in an event created by an Organiser.
- Supporter means a person who sponsors a Participant or donates to an event.
- Entry fee means a fee an Organiser charges a Participant to take part in an event.
- Sponsorship means money raised by a Participant through their sponsorship page.
- Tip means a voluntary amount a Supporter may choose to give to fun-run.co.uk at the point of giving.
- Support means help provided by the fun-run.co.uk team, if requested.
Using fun-run.co.uk
You must be at least 18 years old to create an account. Accounts are always held by an adult. Where a child takes part in an event, a parent or carer holds the account on their behalf.
You agree to use fun-run.co.uk in a lawful way and not to misuse the platform or try to disrupt it.
Your responsibilities
If you create an account, you're responsible for keeping your login details safe. Anything done through your account is your responsibility.
If you publish content on fun-run.co.uk (for example, an event page, a participant's sponsorship page, or information about your group), you are responsible for making sure it's accurate, up to date, and not misleading.
Organising an event
If you use fun-run.co.uk to organise an event, you are responsible for the event itself. This includes:
- running the event safely and lawfully
- obtaining any permissions, licences or insurance the event requires
- carrying out any risk assessment appropriate to the event
- the health and safety of participants, volunteers and the public on the day
- the accuracy of what you tell participants and supporters about the event
fun-run.co.uk provides the platform you use to set up the event, take sign-ups and collect sponsorship. We do not organise, run, supervise or take responsibility for your event. The decisions about how to run your event safely and lawfully are yours.
Content rules
You must not upload, share or promote content that is illegal, harmful, or abusive. This includes:
- illegal content or content that breaks any laws
- hate speech or discrimination
- harassment, bullying or threats
- violent, sexually explicit or graphic content
- content that infringes someone else's copyright or other rights
- fraud, scams or deceptive activity
- spam, viruses, or malicious software
- sharing personal information about others without consent
If you see content that you believe breaks these rules, please report it to fun-run@fundraisy.co.uk. We'll review it and may take action.
Actions we may take
If someone breaks these terms, we may:
- issue a warning
- suspend access to an account
- close an account (in serious or repeated cases)
Stripe payment processing
We use Stripe to process payments. If you take payments through fun-run.co.uk, you'll need your own Stripe account and you must agree to Stripe's terms.
Payments made through your event (entry fees and sponsorship) are processed through your own Stripe account. Stripe may deduct its processing fees, and any fun-run.co.uk platform fee, before funds reach your account.
Stripe provides its services to you directly. fun-run.co.uk is not responsible for Stripe's services, and we are not liable for losses arising from disputes between you and Stripe.
Payments, fees and optional tips
If you use fun-run.co.uk to take payments, you agree to pay any fees that apply to your use of the service. Our fees are set out on our Pricing page.
We charge a platform fee on entry fees. We do not charge a platform fee on sponsorship.
Supporters may be given the option to leave a voluntary tip to support fun-run.co.uk at the point of giving. Any tip is entirely optional and does not form part of the donation to the group. Tips are paid to fun-run.co.uk and remain the property of fun-run.co.uk.
Refunds
Entry fees and sponsorship are collected through the Organiser's own Stripe account. Any refund of an entry fee or sponsorship is a matter between the Participant or Supporter and the Organiser. fun-run.co.uk is not involved in and is not responsible for refunds of entry fees or sponsorship.
Tips paid to fun-run.co.uk are non-refundable, except where required by law or in cases of error or fraud.
Gift Aid
Where the platform captures a Gift Aid declaration from a Supporter, the Organiser is responsible for claiming Gift Aid from HMRC and for ensuring that donations are eligible. fun-run.co.uk does not claim Gift Aid on your behalf and is not responsible for the eligibility of any donation.
Data protection
We are committed to protecting personal data. Our use of personal information is explained in our Privacy Policy.
fun-run.co.uk is registered with the Information Commissioner's Office (ZB659322).
Intellectual property
The fun-run.co.uk website and its content (including design, text, graphics and branding) belong to us or our licensors and are protected by intellectual property laws.
You may not copy, reuse or distribute content from fun-run.co.uk without our written permission, unless the law allows it.
Limitation of liability
We do our best to keep fun-run.co.uk running smoothly, but we can't promise the website or services will always be available or error-free.
To the fullest extent allowed by law, fun-run.co.uk is not liable for any loss or damage arising from your use of (or inability to use) the platform, including indirect or consequential loss such as loss of profits, data, or goodwill. We are not liable for any event organised using the platform, which is the responsibility of the Organiser.
Indemnity
If your use of fun-run.co.uk causes legal claims against us (for example, because you broke these terms or the law, or in connection with an event you organised), you agree to cover any losses or costs we reasonably incur as a result.
Governing law
These terms are governed by the laws of England and Wales. Any disputes will be handled by the courts of England and Wales.
Changes to these terms
We may update these terms from time to time. Changes take effect as soon as they are posted on this page. If you continue to use fun-run.co.uk after an update, you're agreeing to the updated terms.
